In accordance with the provisions of Article 6-III of the French Law n° 2004‑575 of 21 June 2004 for Confidence in the Digital Economy (Loi pour la confiance dans l’économie numérique), Users of the website accessible at the URL https://www.scientific‑acupuncture.eu (hereinafter the “Website“) are hereby informed of the identity of the various parties involved in its publication and operation.

The Association is currently undergoing formal declaration with the competent French administrative authority, namely the Préfecture de Police of Paris, pursuant to Article 5 of the French Law of 1 July 1901. Until publication of an extract of such declaration in the Journal officiel des associations et fondations d’entreprise, the Association shall not benefit from the full legal capacity provided for by Article 6 of the said Law. The information set out in the present Legal Notice shall be updated as soon as the declaration formalities are completed, in particular with the addition of the unique identification number of the Association (RNA) and, where applicable, its SIREN number.
2. Director of Publication
Pursuant to Article 93‑2 of the French Law n° 82‑652 of 29 July 1982 on audiovisual communication, the Director of Publication of the Website is Dr Nadia Volf, in her capacity as President of the Association.

4. Intellectual Property
4.1 The Website, taken as a whole, as well as each of the elements composing it — including without limitation its general structure, graphic design, ergonomics, texts, photographs, illustrations, logos, trademarks, distinctive signs, sounds, videos, software, databases and any other content of any nature whatsoever — constitutes a work of authorship protected by the provisions of the French Intellectual Property Code (Code de la propriété intellectuelle) and by applicable international conventions, in particular the Berne Convention for the Protection of Literary and Artistic Works of 9 September 1886, as revised.
4.2 ESSA holds, or has been duly authorised to use, all intellectual property rights pertaining to the Website and its contents. All rights of reproduction, representation, adaptation, translation and distribution are reserved, worldwide and for the entire duration of legal protection of such rights, including for documents made available for download.
4.3 Any total or partial reproduction, representation, modification, publication, transmission, alteration, extraction, reuse or exploitation, by any means and on any medium whatsoever, of all or part of the Website or of the elements composing it, without the prior, express and written authorisation of ESSA, is strictly prohibited and shall constitute an act of infringement (contrefaçon) within the meaning of Articles L. 335‑2 et seq. of the French Intellectual Property Code, rendering the perpetrator liable to civil and criminal sanctions.
4.4 By way of exception to the foregoing, short quotations are permitted, provided that the name of the author and the source are clearly mentioned, in accordance with the conditions set out in Article L. 122‑5, 3° (a) of the French Intellectual Property Code.
4.5 The denomination “European Society of Scientific Acupuncture”, the acronym “ESSA” and the associated logo constitute distinctive signs of the Association and shall not be reproduced or used, in any context whatsoever, without its prior written authorisation.
5. Hyperlinks
5.1 Outgoing links. The Website may contain hyperlinks directing the User to third‑party websites over which ESSA exercises no editorial control. ESSA shall in no event be liable for the content, accuracy, lawfulness or availability of such third‑party websites, nor for any use thereof made by the User. The activation of such links shall be the User’s sole responsibility.
5.2 Incoming links. The creation of any hyperlink directing to the Website, in whole or in part, is subject to the prior express written authorisation of the Director of Publication. Any link established in breach of this requirement may, without prior notice, be the subject of a request for removal addressed to its publisher and, where applicable, to the relevant hosting provider, without prejudice to any other remedy available to ESSA.
6. Liability
6.1 ESSA endeavours, to the best of its ability and within the limits of the means at its disposal, to ensure the accuracy, completeness and timeliness of the information published on the Website. However, ESSA shall not be liable for any error, omission, inaccuracy, or for any temporary or permanent unavailability of the Website or of any of its functionalities.
6.2 The information published on the Website is provided for general informational purposes only. It shall under no circumstances be construed as constituting medical advice, a medical opinion, a diagnosis or a recommendation of treatment. Users are expressly invited to consult a duly qualified healthcare professional for any question relating to their health.
6.3 To the fullest extent permitted by applicable law, ESSA shall not be liable for any direct or indirect damage, of any nature whatsoever, resulting from access to, use of, or inability to use the Website, or from the use of any information made available thereon, or from any computer virus, malicious code or other harmful element that may be transmitted through the Website.
7. Personal Data
The processing of personal data carried out in connection with the Website is governed by the Privacy Policy of ESSA, available at https://scientifc-acupuncture.eu/index.php/privacy-policy/, which forms an integral part of the present Legal Notice and to which Users are invited to refer.
8. Applicable Law and Jurisdiction
The present Legal Notice is governed exclusively by French law. Any dispute arising out of or in connection with the present Legal Notice or with the use of the Website shall, in the absence of an amicable settlement reached within a reasonable period, be submitted to the exclusive jurisdiction of the competent French courts of the ressort of the Court of Appeal of Paris, notwithstanding multiple defendants, third‑party claims or summary proceedings, and notwithstanding the rules governing conflicts of jurisdictions.
