4.1 The Website, taken as a whole, as well as each of the elements composing it \u2014 including without limitation its general structure, graphic design, ergonomics, texts, photographs, illustrations, logos, trademarks, distinctive signs, sounds, videos, software, databases and any other content of any nature whatsoever \u2014 constitutes a work of authorship protected by the provisions of the French Intellectual Property Code (Code de la propri\u00e9t\u00e9 intellectuelle<\/em>) and by applicable international conventions, in particular the Berne Convention for the Protection of Literary and Artistic Works of 9 September 1886, as revised.<\/p>\n\n\n\n4.2 ESSA holds, or has been duly authorised to use, all intellectual property rights pertaining to the Website and its contents. All rights of reproduction, representation, adaptation, translation and distribution are reserved, worldwide and for the entire duration of legal protection of such rights, including for documents made available for download.<\/p>\n\n\n\n
4.3 Any total or partial reproduction, representation, modification, publication, transmission, alteration, extraction, reuse or exploitation, by any means and on any medium whatsoever, of all or part of the Website or of the elements composing it, without the prior, express and written authorisation of ESSA, is strictly prohibited and shall constitute an act of infringement (contrefa\u00e7on<\/em>) within the meaning of Articles L. 335\u20112 et seq.<\/em> of the French Intellectual Property Code, rendering the perpetrator liable to civil and criminal sanctions.<\/p>\n\n\n\n4.4 By way of exception to the foregoing, short quotations are permitted, provided that the name of the author and the source are clearly mentioned, in accordance with the conditions set out in Article L. 122\u20115, 3\u00b0 (a) of the French Intellectual Property Code.<\/p>\n\n\n\n
4.5 The denomination “European Society of Scientific Acupuncture”, the acronym “ESSA” and the associated logo constitute distinctive signs of the Association and shall not be reproduced or used, in any context whatsoever, without its prior written authorisation.<\/p>\n\n\n\n
\n\n\n\n5. Hyperlinks<\/h2>\n\n\n\n
5.1 Outgoing links.<\/strong> The Website may contain hyperlinks directing the User to third\u2011party websites over which ESSA exercises no editorial control. ESSA shall in no event be liable for the content, accuracy, lawfulness or availability of such third\u2011party websites, nor for any use thereof made by the User. The activation of such links shall be the User’s sole responsibility.<\/p>\n\n\n\n5.2 Incoming links.<\/strong> The creation of any hyperlink directing to the Website, in whole or in part, is subject to the prior express written authorisation of the Director of Publication.
